Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the alliancetariff.com website (the "Site") and any services provided by Alliance Tariff ("Alliance Tariff," "we," "us," or "our"). By accessing the Site or engaging our services, you agree to these Terms. If you do not agree, do not use the Site or engage our services.

1. Important Disclaimer — We Are Not a Law Firm

Alliance Tariff is not a law firm and does not provide legal advice or legal representation. Nothing on the Site, in our communications, or in our services constitutes legal advice or creates an attorney-client relationship. Our services consist of evaluating eligibility for IEEPA tariff refunds, coordinating ACE portal access, and preparing and submitting refund claims through CBP's CAPE mechanism on behalf of our clients.

Where a client's matter requires legal services — such as formal protests in disputed circumstances or litigation — we coordinate, with the client's consent, with one or more independent law firms ("Attorney Partners"). Engagements with Attorney Partners are governed by separate engagement letters between the client and the Attorney Partner. Any attorney-client relationship that exists in connection with such legal work exists solely between the client and the Attorney Partner, not with Alliance Tariff.

2. Services

Our services may include:

  • Free eligibility analysis of potential IEEPA tariff refund claims.
  • Coordination of ACE portal account setup, recovery, or third-party access.
  • Preparation and submission of CAPE refund filings through CBP.
  • Coordination with Attorney Partners on protest filings and litigation when warranted.
  • Status tracking and client communication during the refund process.

The specific scope of services for any client is set forth in a separate written engagement agreement.

3. Fees

Unless otherwise expressly agreed in a written engagement, our fees are charged on a contingency basis as a percentage of refunds actually recovered for the client. Fee tiers are based on total recovered refund amount and are disclosed before engagement. Fees for any work performed by Attorney Partners are separate, are governed by the client's engagement with the Attorney Partner, and are disclosed in advance.

4. No Guarantees

We do our best work for every client, but we do not — and cannot — guarantee any specific outcome, refund amount, or processing time. Refund amounts and timelines are determined by CBP and are subject to applicable laws, regulations, deadlines, and CBP processing capacity. Past results do not guarantee future outcomes.

5. Client Responsibilities

To enable us to perform our services, the client agrees to:

  • Provide complete, accurate, and timely information about their imports, entries, and prior customs activity.
  • Provide and maintain the necessary ACE portal access and authorizations.
  • Promptly review and execute documents reasonably needed to advance the claim.
  • Comply with all applicable laws and regulations relating to their import activity.

We rely on the accuracy of information provided by the client and are not responsible for outcomes resulting from inaccurate, incomplete, or untimely information.

6. Confidentiality

We treat client information as confidential and disclose it only as necessary to provide services or as required by law. See our Privacy Policy for additional detail on how we handle personal information.

7. Intellectual Property

All content on the Site — including text, graphics, logos, and software — is the property of Alliance Tariff or its licensors and is protected by applicable intellectual-property laws. You may not copy, reproduce, distribute, or create derivative works of Site content without our prior written consent.

8. Acceptable Use

You agree not to (a) use the Site or our services in violation of any applicable law, (b) attempt to interfere with the operation of the Site, (c) submit knowingly false information, or (d) misuse our services to make false or fraudulent refund claims.

9. Disclaimers

THE SITE AND OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ALLIANCE TARIFF AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR OUR SERVICES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR OUR SERVICES WILL NOT EXCEED THE AMOUNT OF FEES YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Alliance Tariff and its affiliates from and against all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use of the Site, (b) your breach of these Terms, (c) information you provide to us that is inaccurate or misleading, or (d) your violation of applicable law.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.

13. Termination

We may suspend or terminate access to the Site or services, in whole or in part, at any time and for any reason, including breach of these Terms. Termination of services for engaged clients is governed by the terms of the applicable written engagement agreement.

14. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
